| 许可证描述： | END USER LICENSE AGREEMENT This End User License Agreement (hereinafter—“Agreement”) is a binding contract between You as a person or entity (hereinafter—“You”) and Autonomous nonprofit organization “TV-Novosti” (hereinafter—ANO “TV-Novosti”). By installing the Font You hereby agree to comply with the terms of this Agreement. PLEASE READ THE TERMS OF THIS AGREEMENT BEFORE DOWNLOADING, INSTALLING OR OTHERWISE OBTAINING ACCESS TO OR USE OF THE FONT PROVIDED BY ANO “TV-NOVOSTI”. OWNING AN EXCLUSIVE LICENSE FROM THE RIGHTS HOLDER, ANO “TV-NOVOSTI” HAS THE REQUIRED SCOPE OF RIGHTS AND AUTHORITIES TO GRANT THE LICENSE TO USE THE FONT. FONTS ARE PROTECTED BY COPYRIGHT LAW, AND BY THIS AGREEMENT, YOU ARE GRANTED AN ORDINARY NON-EXCLUSIVE LICENSE TO USE THE FONT WITHOUT THE RIGHT TO SALE OR TRANSFER IT TO ANY THIRD PARTIES BY DOWNLOADING, INSTALLING OR OTHERWISE USING THE FONT. VIOLATION OF THIS AGREEMENT SHALL BE SUBJECT TO LIABILITY ACCORDING TO THE LAWS OF THE RUSSIAN FEDERATION. YOU ACKNOWLEDGE THE FACT THAT YOU HAVE READ THIS AGREEMENT, YOU UNDERSTAND THE TERMS AND CONDITIONS THEREOF, YOU ACCEPT THEM AND AGREE TO BE BOUND BY THEM. IF YOU ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT ON BEHALF OF AN ENTITY, ACTING AS AN AUTHORIZED REPRESENTATIVE OF SUCH ENTITY, THEN YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT AND AUTHORITY TO BIND SUCH ENTITY BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, AND REFERENCES TO THE “END USER'” IN THIS AGREEMENT ARE RELATED TO YOU AS A PERSON, AS WELL AS TO AN ENTITY ON BEHALF OF WHICH YOU ENTER THIS AGREEMENT. IF YOU DO NOT INTEND TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU SHOULD CLICK ON THE “I DO NOT ACCEPT THE TERMS OF THIS AGREEMENT” (I DO NOT ACCEPT) OR ANY OTHER SIMILAR BUTTON, INTERRUPT THE DOWNLOADING AND/OR INSTALLING PROCESS AND IMMEDIATELY CEASE AND DESIST FROM THE ATTEMPTS TO USE THE FONTS AND DELETE ALL COPIES YOU HAVE OF THE FONT PROVIDED BY ANO “TV-NOVOSTI”. THIS AGREEMENT TOGETHER WITH ANY ADDITIONAL DOCUMENTS OR CONDITIONS INCLUDED HEREIN BY REFERENCE SHALL CONSTITUTE THE ENTIRE AGREEMENT BETWEEN THE USER AND ANO “TV-NOVOSTI” IN RELATION TO THE FONT AND SUPERSEDE ALL PRIOR WRITTEN AND ORAL PROPOSALS, REPRESENTATIONS OR ARRANGEMENTS THAT MIGHT HAVE EXISTED BETWEEN YOU AND ANO “TV-NOVOSTI” WITH REGARD TO THE SUBJECT HEREOF. BY DOWNLOADING, INSTALLING AND/OR USING THE FONT YOU CONFIRM THAT YOU UNDERSTAND AND ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU HAVE THE RIGHT TO CONCLUDE IT. AFTER CONFIRMATION, ANO “TV-NOVOSTI” SHALL GRANT YOU A NON-EXCLUSIVE LICENSE TO USE THE FONT WITHOUT THE RIGHT TO TRANSFER IT, AND UNDER THE FOLLOWING CONDITIONS. 1. Definitions “Font” means a graphical representation of an ordered stylistic and compositional set of letters, digits, orthographic and other symbols composing the Font called “May” realized in a digital or other objective form (“Font file”) that makes it possible to display the Font by means of a computer and other electronic devices. “Font software” means a computer program called “May” (working title) meant to form and display the Font “May” in operational systems and other devices. “You”, “your” (and other derivatives) and “End User” each means a person or entity gaining access to the Font by downloading the Font file. The End User shall not be a distributor, agent, intermediary, reseller, manufacturer of complete sets of equipment, or any other wholesaler. “Permitted electronic device” means any electronic device for displaying the Font including desktop PC, laptop, smartphone, etc. “Rights holder” means LLC Contrast Foundry (LLC CoFo) 2. Subject of the Agreement 2.1. ANO “TV-Novosti” hereby grants You at no cost and You accept a limited, ordinary (non-exclusive) license to use the Font (including the Font software) on the Permitted electronic device (exclusively in machine-readable object code form) and in the manner permitted by this Agreement (hereinafter—the “License”). The License shall be granted without the right to transfer it to any third parties (in whole or in part) under terms of sub-license or assignment; the License shall be used without restrictions as to the territory, all over the world for the validity period of the exclusive right in the Font. For the purposes of this Agreement, the “Font” shall include any updates, enhancements, functional modifications, new versions or additions to the Font available to users on the website of ANO “TV-Novosti” https://pobeda.page . Notwithstanding the foregoing, ANO “TV-Novosti” shall not be committed to providing any updates, functional enhancements, modifications, revisions or additions to the Font. 2.2. Under this Agreement You are granted the right for non-commercial use as follows: − using the Font on Your websites where You are registered as a person or entity. − installing and using the Font on a PC belonging to you as a person or entity. At that, PCs with the Font installed may be connected to any amount of external devices such as laser printers, inkjet printers, phototypesetting devices or film recorders. Installation of the Font on a server is permitted only for personal computer mode. In such a case, installation shall mean installation on one computer. − reproducing the Font characters for non-commercial purposes on any medium and surface, in particular, on paper, computer monitors, clothes and any other surfaces without any limitations as to the volume and quantity, provided that the images of the Font characters are not used exclusively as full alphabets and graphic sets. For the purposes of this Agreement, the term “graphic sets” means, without limitation, stamps, clichés, die-cut shapes and any other devices used for application and fixing of alphabets via tattoos, by means of fusing or adhesion. − using the images of the Font characters in video formats, in particular, as captions and prints in video materials not intended for commercial use. 2.3. Usage of the Font on website pages must be accompanied by the Font copyright information similar to that represented in HTML/CSS examples supplied with the Font: Copyright © Copyright (c) 2019 LLC Contrast Foundry (LLC CoFo). All rights reserved. 2.4. You have the right to create only one (1) copy of the Font solely for the purpose of backup or archiving. Except for specific cases and only in a limited scope permitted by the applicable law, you have no right to make engineering analysis and decompile the Font, try to change or access the source code of the Font, disassemble or transform the Font in any other manner, or assign any third parties to perform the abovesaid. You have no right to modify or adapt the Font. 2.5. Any commercial use of the Font is forbidden. You may not sublicense, rent, lease, sell, or temporarily transfer your rights in relation to Fonts. You undertake to provide proper protection against unauthorized access to and copying of the Font by any third parties. 2.6. ANO “TV-Novosti” shall not provide any technical support services under this Agreement. The rights holder shall not undertake to provide any updates, functional enhancements, modifications, revisions, or additions to the Font, and this Agreement shall not grant You with any rights in respect of all of the above. If You have any problems with installation and functioning of the Font on Your Permitted electronic device the Rights holder shall have no liability whatsoever. 2.7.Embedding of the Font images into website pages and/or digital documents to be transferred to third parties (e.g. EPS or PDF documents) shall be permitted only if such documents are meant to be viewed and printed only and cannot be edited (the “Print & Preview” mode). It is restricted to use such documents for commercial distribution as digital books, magazines or templates meant for commercial publications. You agree not to change the built-in Fonts and not to bypass the restrictions that prevent extraction of the Fonts. You may not embed the Fonts into games, applications, software, gaming devices, e-books, navigation devices and other devices where the Font is displayed on the control screen. 3. Intellectual Property Rights and Ownership This Agreement shall not grant you any rights of ownership or other rights in relation to the Fonts. All rights not expressly granted to You under this License belong to the Rights holder. 4. Consent to the Data Usage You agree that ANO “TV-Novosti” shall have the right to collect and use your technical data and related information, including but not limited to technical information about your device, system and application software and peripherals, such information being periodically collected to facilitate provision of the product support and other services (if any) associated with the Font. ANO “TV-Novosti” may use this information, provided that such use is made in a form that does not identify you personally, in order to enhance the website, develop and improve the Font. And to prevent or investigate illegal or improper use of the Font. If while achieving the above objectives, ANO “TV-Novosti” obtains any data that according to the definition set forth in the applicable law of Your jurisdiction shall be deemed Your personal information, You hereby consent to grant ANO “TV-Novosti” the right to collect, record, organize, accumulate, store, clarify, extract, use, transfer (including cross-border transfer), access, depersonalize, block, delete your personal information collected by ANO “TV-Novosti”. 5. Warranties and Liability Limitations The License to use the Font under this Agreement is provided “AS IS” and ANO “TV-Novosti” shall not be liable for fitness of the Font for a particular purpose of the End user. ANO “TV-Novosti” shall not warrant uninterrupted or error-free operation of the Font or absence of defects in it. ANO “TV-Novosti” in no event shall be liable to You or any third party for any incidental, consequential or indirect damages through the use of the Font. 6. Applicable Law The Agreement and legal relations arising therefrom shall be governed by the laws of the Russian Federation to the extent that they relate to contracts concluded and performed entirely on the Russian territory, exclusive of conflict-of-law rules. 7. Coming into Force and Effect 7.1. This Agreement shall come into force from the date of your acceptance of the terms and conditions hereof (including through the use of “I ACCEPT THE TERMS OF THIS AGREEMENT” (“I ACCEPT”) BUTTON OR ANY OTHER SIMILAR BUTTON). Also, after you download, install, access and start using the Font, even if the terms of this Agreement have not been expressly accepted by You. This Agreement shall be valid for the validity term of the exclusive rights in the Font. 7.2. ANO “TV-Novosti” may at its own discretion early terminate this Agreement without notice. In this case You must destroy all Your copies of the Font including backup copy. 8. Severability of the Agreement Provisions If any term or provision of this Agreement is considered null and void or unenforceable by any court or administrative body, such consideration shall not affect the validity or enforceability of the remaining terms and conditions of this Agreement. To the maximum extent possible under the law, provisions of this Agreement shall be interpreted and enforced so as to carry out the original purpose of the Agreement, and, if such an interpretation and execution is impossible according to the law, such provision shall be deemed excluded from this Agreement. 9. Changes ANO “TV-Novosti” shall have the right to introduce changes to future versions of this Agreement at any time without prior notice. |
